Reported Cases

Our attorneys have appeared in over one hundred reported appellate cases from the North Carolina Court of Appeals, the North Carolina Supreme Court, and federal circuit courts of appeals. Each case is unique and must be evaluated on its own merits. The outcome of a particular case cannot be predicated upon a lawyer's or a law firm's past results. Some of our recent notable cases are listed below.

McDonald's Corp v. Five Stars, Inc., 365 N.C. 196 (2011) The firm represented McDonald's Corp. in a multi-year commercial lease dispute, culminating in the North Carolina Supreme Court affirming summary judgment in favor of our client.

Kinlaw v. Harris, 364 N.C. 528 (2010) The North Carolina Supreme Court held that our client's Individual Retirement Accounts were exempt from a judgment against him.

Barbour v. Dinkel, 201 N.C.App. 446 (2009). The North Carolina Court of Appeals affirmed the dismissal of a $733,000 claim against the estate of our client.

Union v. Branch Banking & Trust Co., 176 N.C. App. 711 (2006) The firm represented BB&T in a lawsuit alleging negligent management of trust accounts. The North Carolina Court of Appeals affirmed summary judgment in favor of our client.

RD&J Properties v. Lauralee-Dilton Enterprises, LLC 165 N.C. App. 737 (2004) The firm's client was the seller of two large mobile-home parks who was sued for breach of contract. The North Carolina Court of Appeals upheld summary judgment in favor of our client.

Showcase Realty and Construction Company v. City of Fayetteville Board of Adjustment, 155 N.C.App. 548 (2002). The firm represented the neighbor of a storage facility that sought a variance from Fayetteville's zoning laws. The city granted the variance, but the firm successfully overturned that grant at the North Carolina Court of Appeals.

Howell v. City of Lumberton, 144 N.C. App. 695 (2001). The North Carolina Court of Appeals upheld our client's negligence judgment against the city of Lumberton.

Melvin v. Kelly Springfield Tire Co., 232 F. 3d. 888 (2000) (unpublished) The United States Court of Appeals for the Fourth Circuit upheld the district court's grant of summary judgment in favor of our clients.
